Gabe’s Gift Card Terms & Conditions Issued by Mountaineer Corporate Services LLC

The Gabriel Brothers, Inc. (“Gabe’s”) gift card (“Gift Card”) is issued by Mountaineer Corporate Services LLC, a Virginia limited liability company, (“MCS LLC”) and will be honored at all Gabe’s locations based on the terms and conditions set forth in this document. These terms and conditions are issued by MCS LLC as the issuer of the Gabe’s Gift Card and govern its purchase, use, redemption at Gabe’s locations, and other terms. MCS LLC is the card issuer and sole obligor to card owner.

Purchase, use or acceptance of the card constitutes consent to the following terms and conditions and those found on the back of the card (“collectively, the “Terms and Conditions”). MCS LLC reserves the right to change these Terms and Conditions at any time, without notice, and recommend that you check these Terms and Conditions periodically for any changes. These Gabe’s Gift Card Terms and Conditions were last updated on January 3, 2023.

Gabe’s Gift Cards must be presented at the time of redemption. Gabe’s Gift Cards are redeemable for merchandise only at Gabriel Brothers, Inc. (“Gabe’s”) locations. Gabe’s Gift Cards are not redeemable for the purchase of another Gabe’s Gift Card or towards previously purchased merchandise. Return of merchandise purchased with this card is subject to the store’s Return Policy.

Protect this Gift Card and treat it as you would cash. If the Gabe’s Gift Card is lost, stolen, damaged or used without authorization, it will not be replaced. However, in certain cases, if the Gabe’s Gift Card has not been used or redeemed and you have the original Gabe’s Gift Card number and proof of purchase (original sales receipt), we may be able to reissue a new card; please call our Customer Support team at 1-800-458-6546 for further assistance.

Gabe’s Gift Cards may be purchased as a gift or given in place of issuing a credit to a credit card or a proof of purchase return from other payment methods. Returns may be applied to this card. Gabe’s Gift Card is not valid until activated at the register. Gabe’s Gift Cards are not credit, debit, or charge cards, and have no implied warranties. Neither MCS LLC nor Gabe’s make any warranties, express or implied, with respect to Gabe’s Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a Gabe’s Gift Card is non-functional, your sole remedy, and MCS LLC’s sole liability, shall be the replacement of such Gabe’s Gift Card. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. Accordingly, some of the foregoing limitation of liability provisions may not apply to you.

Gabe’s Gift Cards are not redeemable for cash and are non-refundable or returnable except in states where required by law. Each time you use your Gabe’s Gift Card for purchases, MCS LLC will deduct the purchase amount from your Gabe’s Gift Card balance upon use until the balance reaches zero.

Resale of Gabe’s Gift Cards is prohibited. Resale or attempted resale is grounds for seizure and cancellation of the card without compensation. Neither Gabe’s nor MCS LLC shall be liable for cards purchased from any third parties. Gabe’s and MCS LLC reserve the right to deactivate or reject any card issued or procured, directly or indirectly, in connection with fraudulent action or illegal means.

Gabe’s Gift Cards have no expiration dates or service fees assessed for use or inactivity.

Any and all disputes relating in any way to Gabe’s Gift Cards shall be submitted to confidential arbitration in Morgantown, West Virginia, USA, except that, to the extent you have in any manner violated or threatened to violate MCS LLC’s or Gabe's intellectual property rights, MCS LLC or Gabe's may seek injunctive or other appropriate relief in any state or federal court in the State of West Virginia, USA and you consent to the exclusive jurisdiction and venue in such courts. Arbitration shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise.

MCS LLC reserves the right to change these terms and conditions from time to time in its sole discretion, and any purchase of a Gabe’s Gift Card after such change shall constitute acceptance to these terms and conditions. Unless otherwise required by law, these terms and conditions shall be governed and construed in accordance with the laws of the State of West Virginia (without regard to principles of conflicts of laws that would call for the application of the law of any other jurisdiction).

Check Your Card Balance

If you already have a Gabe’s Gift Card and want to check your balance, bring your card to any Gabe’s store and any cashier will be happy to provide you with your balance or if you prefer, call 1-866-650-6049. Please have your card number available when calling.

Please keep in mind that if you just made a purchase this balance may be an estimate only as there may be occasions when the updated balance is delayed for a period of up to 24 hours immediately following a purchase. However, each time you use your Gabe’s Gift Card, your register receipt will indicate the balance remaining on your card.
